The attached prior concurrent use proceeding involved three parties: the present applicant, another applicant, and a third-party common law user. The outcome of that proceeding was a three-way geographic division of rights, resulting in two registrations subject to geographic limitations alongside the common law user’s established territory.Since that time, one of the registrations issued in the prior proceeding has lapsed. Accordingly, the applicant is now entitled to the geographic territory that had previously been assigned to the lapsed registration, while still respecting and maintaining the geographic rights of the common law user as determined in the prior proceeding.
