Before February 27, 2020, Applicant openly used the TACO WARS mark in commerce in at least Louisiana and Texas, and is continuing to use the mark in commerce in at least such geographic areas. No. 6152298 ('298) "TACO WARS," applied for on February 27, 2020. To applicant's knowledge, the owner of the '298 reg. mark has not expanded their use of the mark in commerce beyond New Mexico since it began using the mark. At the time of the '298 registration, Applicant was unaware of the remote use by the now owner of the owner of the '298 reg. mark.
