Upon information and belief, based at least upon the representation in the trademark application listed below and the corporate records of the State of Texas for Nickel Mania, Inc., the Applicant states that the use described below is an exception to the exclusive use by the Applicant of the trademark words NICKEL MANIA: A concurrent use by Nickel Mania, Inc., a Texas corporation, and/or James L. Rowe, an individual with a Texas address. Nickel Mania, Inc. appears to have the following corporate address: 3525 Melanie Lane, Plano, Texas 75023, and James L. Rowe appears to have following address: 2661 Midway Road, Suite 218, Carrollton, Texas 75006. James L. Rowe is listed as the owner of the following trademark registration application: Application No. 90610110, Filed March 29, 2021, for the mark NICKEL MANIA in standard characters, listing the following services: "Amusement arcade services; Amusement arcades; Amusement centers; Providing amusement arcade services." Application No. 90610110 claims a date of first use anywhere and first use in commerce at least as early as "00/00/1996." Upon information and belief, the concurrent use by Nickel Mania, Inc. and/or James L. Rowe have been in Carrollton, Texas, specifically at an amusement center located at 2661 Midway Road, Suite 218, Carrollton, Texas 75006. The Applicant seeks a registration for use of the trademark described herein in the State of Utah for the following services: Amusement arcade services; Amusement arcades; Amusement centers; Providing amusement arcade services.
