The mark consists of three-dimensional trade dress boot design for which the following primary features are claimed: 1) distinctive stitchdown construction, which is a double row of stitching that is visible as it wraps around the outside of the boot and which stitches down the upper to the sole in its stitching down of the upper to the sole; 2) unique 3 row stitch pattern on the seam that connects the quarters (side panel) with the vamp (forefoot): there are 2 tightly stitched rows, followed by a gap approximately 5mm wide, and then a third single row of stitching; 3) intentionally low flattened profile in the toe box; 4) intentionally low profile with the overall height of the boot of only 4.75" while most lace up boots are a minimum of 6"; 5) shorter heel: the height of the heel is 1" while most other work boots are made with a 2" heel; 6) logo with the words "VIBERG SINCE 1931" written in the central region of the insole with a horizontal line under the term "VIBERG". The remaining design elements of the shoe, including the quarter, the tongue, the shoelaces, the eyelets, the insole, the vamp and the toe cap, all shown in broken lines, are not claimed as features of the mark but serve only to show placement of the mark.
