Applicant seeks registration of the GREENFIELD SENIOR LIVING mark in connection with "providing retirement homes and assisted living facilities" for the entire United States, except for the State of Oregon. Greenfield Health System, LLC (the "Excepted User"), with an address of 9450 SW Barnes Road, Suite 100, Portland Oregon 97225, owns a trademark registration for the mark GREENFIELD (Reg. No. 4578882) with the US Patent and Trademark Office ("PTO") and claims to have used the mark in commerce in connection with "health care services; medical clinics; medical radiology services; medical testing for diagnostic or treatment purposes; providing information in the field of medicine and preventative care via a website on the internet; medical services, namely, providing medical information in the nature of targeted patient advisories and targeted alerts delivered via email and a website on the internet" since July 1, 2002. To the verifier's knowledge, the Excepted User uses its mark in the advertising of its services online via its website and electronic newsletters and in connection with the provision of its services at two clinics in the Greater Portland, Oregon area. The Excepted User filed its application with the PTO on August 27, 2013. Applicant has used its mark in commerce since at least as early as June 30, 2005, prior to the filing date of the Excepted User's application.
