Based on the final Order of the United States District Court for the Northern District of Illinois, Eastern Division, in Case No. 13 C 5478, in which Applicant is the Plaintiff and Champion Window Manufacturing and Supply Co., LLC, Champion Window Company of Chicago, LLC, and Champion Window Company of Merrillville, LLC are the Defendants, any application of Applicant in which the goods or services pertain to roofs, roofing, roofing installation or roofing services, in International Class 037, Applicant's geographical area shall include only the geographical area described below, within which Applicant may use the mark CHAMPION in association with roofs, roofing, roofing installation and roofing services: A circle with a seventy (70) mile radius, with its center point in the city of Chicago, Illinois, at the intersection of Jackson Boulevard and S. Federal Street; excluding from the circle, however, those parts of Wisconsin, Indiana, Michigan that would otherwise be within the 70 mile radius circle and further excluding those portions of Rockford, Illinois within the 70 mile radius with the following zip codes: 60129, 60146, 60518, 60530, 60553, 61008, 61012, 61016, 61038, 61049, 61052, 61065, 61068, 61353.

Subject to Concurrent Use Proceeding with Champion Window Manufacturing and Supply Co., LLC, Champion Window Company of Chicago, LLC, Champion Window Company of Merrillville, LLC and Champion Roofing, Inc., 12121 Champion Way, Cincinnati, Ohio 45241, Applicant claims the exclusive right to use the mark in the area comprising: a. Applicant is entitled to use the "Champion" mark in commerce for roofs, roofing or roofing services in the Chicagoland area, as defined by a circle with a seventy (70) mile radius, with its center point in the city of Chicago, Illinois, at the intersection of Jackson Boulevard and S. Federal Street; excluding from the circle, however, those parts of Wisconsin, Indiana, Michigan that would otherwise be within the 70 mile radius circle and further excluding those portions of Rockford, Illinois within the 70 mile radius with the following zip codes: 60129, 60146, 60518, 60530, 60553, 61008, 61012, 61016, 61038, 61049, 61052, 61065, 61068, 61353; b. Champion Window Manufacturing and Supply Co., LLC, Champion Window Company of Chicago, LLC, Champion Window Company of Merrillville, LLC and Champion Roofing, Inc. are entitled to use the "Champion" mark in commerce for roofs, roofing or roofing services in the United States, except in the Chicagoland area, as defined by a circle with a seventy (70) mile radius, with its center point in the city of Chicago, Illinois, at the intersection of Jackson Boulevard and S. Federal Street; excluding from the circle, however, those parts of Wisconsin, Indiana, Michigan that would otherwise be within the 70 mile radius circle and further excluding those portions of Rockford, Illinois within the 70 mile radius with the following zip codes: 60129, 60146, 60518, 60530, 60553, 61008, 61012, 61016, 61038, 61049, 61052, 61065, 61068, 61353.
