The mark consists of a three-dimensional configuration of the bottle for the goods with wording and two-dimensional designs thereon. The cap of the container is brown in color on which the phrase "EL RON MAS PREMIADO" is partially showing in black. There is a gray label perpendicular to the cap with a red bat with the word "BACARDI" in red above the bat and below the bat encompassed in a red circular stamp partly blocking the brown wording "EL RON MAS PREMIADO" over "EST. 1862" and "FACUNDO" in script. A wreath design is partially visible over "EL RON" and "EST. 1862". The bottom portion of the bottle shows embossing. At the top of the embossing is the tan wording "EL RON MAS PREMIADO". At the center of the label are a brown male and female dancer dancing in a cityscape with the diagonal white words over them "FACUNDO EXQUISITO RUM". On the right side of the label is a brown "X" and a tan "23". The image is in a square frame shape. At the bottom of the embossment is a white "X23". The bottom of the bottle shows "FACUNDO" embossed. A brown liquid is shown inside the bottle to indicate location of the goods, but neither the liquid nor the brown color of the liquid is claimed as a feature of the mark. The dotted lines outlining the container and cap indicate placement of the mark and are not part of the mark.
