The mark consists of a three-dimensional configuration of the bottle for the goods with wording and two-dimensional designs thereon. The cap of the container is brown in color on which the phrase "EL RON MAS PREMIADO" is partially showing in black. There is a gray label perpendicular to the cap with a red bat and the red words "BACARDI" above the bat and the wording "LA MAXIMA CALIDAD" below the bat encompassed in a red circular stamp partly blocking the brown wording "EL RON MAS PREMIADO" over "EST. 1862" and "FACUNDO" in script. A wreath design is partially visible over "EL RON" and "EST. 1862". The bottom portion of the bottle shows embossing. The center of the bottle shows embossed lines emanating from the central feature and making an "X" design. In the center is the black wording "RON" on the left and "DIEZ" on the right of a gray area which shows "EL RON MAS PREMIADO" in white in an arc over a gold building with a gold palm tree next to it and under which appears the gold wording "FACUNDO". This is above the word "EXIMO" in white. Under the word "EXIMO" is the word "RUM" in brown above "DIEZ" and "ANOS" in white with a large brown X between the words. On the bottom is the wording "LA MAXIMA CALIDAD" in gold in a lower arc. At the bottom of the bottle is the embossed word "FACUNDO". A brown liquid is shown inside the bottle to indicate location of the goods, but neither the liquid nor the brown color of the liquid is claimed as a feature of the mark. The dotted lines outlining the container and cap indicate placement of the mark and are not part of the mark.
