On the front of the package is a window through which the goods can be viewed. On the back of the package appears an image of a audio tape cassette with a label that creates the impression that the product is an audio cassette (magnetic) tape. Further, the package is opened in a manner that is identical to the manner in which an audio tape cassette is opened: namely, the package is comprised of two pieces with the first piece comprising the top of the package and the second piece comprising the bottom and sides of the package. When assembled, the two pieces connect such that the package is opened in a "clam shell-style" manner permitting access to the product. The trademarks "KISS," "SECTION 8," and "LIVE NATION" are not parts of the mark. The word "earbuds" is not a part of the mark.
