For the state Class 043 services, Applicant's claim that no other person, firm, corporation, association, or other entity has the right to use the mark in commerce is with the exception of Juan Mean Burrito, Inc., a California corporation located and doing business at 8938 Airport Road, Redding, California 96002 and owner of U.S. Registration No. 4240116 (U.S. Serial No. 85/291746), which has used the mark BURRITO BANDITO since November 2002 in connection with restaurant and restaurant services in the United States except for a geographic location defined by a 250 mile radius surrounding East 9th and Grand, Des Moines, Iowa plus an additional 50 mile radius clockwise from the 5 o'clock position.
