Applicant seeks concurrent use registration for banking, online banking services, trust services, namely investment and trust company services, investment management, and investment advisory services and claims exclusive right to use the Mark in the State of Michigan. Applicant is a party to Concurrent Use Proceeding No. 94001203 concerning Application No.75489009 filed by Founders Bank (Illinois). A Stipulated Consent Order entered in that proceeding by the parties specified Applicant's exclusive use of its mark in the State of Michigan. Based upon those proceedings, Applicant believes that there may be exceptions to its claim of exclusive use, namely Founders Bank (Illinois), 6825 West 111th Street, Worth, IL 60482, owner of Application No. 75489009 that claims rights in the mark FOUNDERS BANK for retail banking and trust services in the entire United States except Michigan and other areas that are the subject of Concurrent Use Proceeding 94001203. Applicant is not aware of any other current exceptions to its claim of exclusive use.
