CONCURRENT USE UNDER C.F.R. § 2.73 The Examining Attorney has indicated that Applicant may be attempting to assert a concurrent use claim in the above-identified application. Applicant submits that it has entered into an agreement with Albert Einstein Healthcare Network ("AEHN"), and that pursuant to that agreement the above-identified application is required to be restricted geographically as follows: "This Registration is restricted to the territory comprising the entire United States, except the counties of Philadelphia, Bucks, Montgomery, Chester, Delaware, and Lehigh in Pennsylvania and the counties of Atlantic, Ocean, Mercer, Burlington, Camden, and Gloucester in New Jersey pursuant to an agreement with a third party." Applicant confirms its intention to assert a concurrent use claim and file its allegation of use at the appropriate time; however, Applicant is not yet prepared to file an Allegation of Use as it has not used the above-identified mark in commerce to date. Applicant further confirms that it does not wish to delete the concurrent use claim from the Application record.
