Desription of the Colors Claimed
The mark consists of Statements Regarding Color Drawing Per the requirements of 37 C.F.R. ยง 2.52(b)(1), Applicant hereby claims the following colors as features of the subject proposed trademark: Orange; White; Purple; Red; and Black. Applicant claims use of these colors in the following ways: 1. Orange: the four-sided diamond on the left-hand side of the mark, as is more fully described elsewhere in this application, is orange in color. 2. White: the eight-point star that is enclosed in the orange diamond, as is more fully described elsewhere in this application, is white in color. 3. Purple: the five "fire point" flame, located in the center of the white, eight-point star, as is more fully described elsewhere in this application, is purple in color. 4. Red: the thick line that begins at the left side of the diamond and continues, unbroken, to the last "E" in "Explosive", as is more fully described elsewhere in this application, is red in color. 5. Black: the letters and words "U.S. Explosive" and "storage", located above and below the red line, respectively, as is more fully described elsewhere in this application, are black in color. Beginning on the left side of the mark, a white, eight-point star is completely enclosed within an orange, four-sided diamond. The points of the star extend to, or nearly to, the four sides of the diamond, or its points. A small purple flame is in the very center of the star. The flame itself has five "fire points". A thick red line begins at the left point of the diamond and runs up the upper left side of the diamond, in diagonal fashion. The line, which is continuous, runs up to the top point of the diamond and down the upper right side of the diamond, in diagonal fashion. The line, still unbroken, runs down to the right point of the diamond and bends slightly to the left, such that the line continues away from the diamond, in horizontal fashion. Above this red horizontal line are written the words "U.S. EXPLOSIVE", which are in heavy, bold black capital letters. The horizontal line ends parallel to, and just beneath, the right-hand most side of the second "E" in "EXPLOSIVE". Just below the horizontal red line, beginning immediately below the "U" in "U.S.", is the word "storage", which is in smaller, bold, black lower case letters. The last letter of the word "storage", "e", is immediately beneath the first "E" in "EXPLOSIVE".
