Concurrent use information. The Applicant seeks registration of the mark for restaurant and bar services everywhere in the United States except a 50-mile radius around Dearborn, Michigan, without restriction as to mode of use. On information and belief, in addition to the Applicant's use of the mark, the mark has been concurrently used in commerce in connection with restaurant and bar services by Khalil Ramadan of 466 Biltmore, Dearborn Heights, Michigan 48127 ("concurrent user") or his privies, since October 22, 2004. On information and belief, the concurrent user owns U.S. Trademark Registration No. 3,568,957. On information and belief, the concurrent user has used the mark in Dearborn, Michigan. Other than use of the mark in association with restaurant and bar services, the Applicant has no knowledge of mode of the concurrent user's use or whether the concurrent user's use has been continuous and exclusive since October 22, 2004. No one else except as specified in the application has the right to use the mark.
