Applicant claims exclusive right to use the mark in the area comprising the entire United States with the exception of Florida. Applicant uses its mark in advertising for its services. To Applicant's knowledge, the only exception to Applicant's claim of exclusive use is use by Atlantic Eye Institute, P.A., the owner of US Reg. No. 3962326 for the mark THE EYE GUYS for "cosmetic and plastic surgery; eyeglass fitting; fitting of contact lenses; fitting of optical lenses; laser and intense pulse light skin enhancement procedures; laser vision correction services; laser vision surgery services; non-invasive cosmetic medical procedures; ophthalmology services; optometry services; treatment of eye disease and conditions," in International Class 44. It is believed such use began in commerce on July 31, 2007, and has been limited to Florida. To the best of Applicant's knowledge and belief no other person, firm, corporation or association except as specified above has the right to use said mark in commerce.
