The mark consists of the overall appearance of a tacker hand tool comprising a configuration as described below and the color red as applied to only a portion of such configured tacker tool. The color red is applied to the upper housing and trigger handle portions, whereas the white areas in the drawing are intended merely to show the relative position of the color portion on the configuration and form no part of the color features of the mark. The primary features of the configuration of the mark comprise a tacker hand tool having a height greater than its length, a square-tubular portion extending at a right-angle to the base edge from the staple-emitting nose to its top in a generally straight line to thereby visually form a generally continuous vertical front edge, and an angular housing forming a continuous incline from the trigger handle to the rear of the tacker.
