Use throughout the United States of America of metal fasteners, namely, bolts, nails, rivets, screws, nuts, and brads. The trademark SBS will be stamped onto the goods and used as an identification under the Fastener Quality Act. The mark SBS SURE LOCK is currently registered to Southern Building Systems, Inc., Corporation Tennessee, 2732 High Blountville, Tennessee 37617 for metal roofing panels. SBS SURE LOCK is registered as serial number 76312173. SBS SURE LOCK has been in use by Southern Building Systems, Inc. since May of 2001. Applicant's mark SBS has been in continuous use at least since 1995. Applicant has not been made aware of any actual confusion between the two marks. Applicant previously had the mark SBS registered under serial number 74/436,810 published on February 28, 1995. Applicant believes that the two marks have and can co-exist without confusion. Applicant amends the application to a concurrent use application and requests reconsideration as such.
