The mark consists of the following. The trade dress consists of the total image, design and appearance of its Classic shoe. The trade dress has the following primary features: (a) Stripes. The visual design feature of five (5) stripes on either side of the shoe; (b) D-Rings. D-shaped Rings used incidentally as part of a lacing system rather than eyelets, hooks, loops or other holding mechanism; and (c) Toe Design. The visual design on the toe of the shoe formed by the stitching. The design is a set of somewhat rectangular stitched patterns from the front tip of the outsole back toward the lacing area of the shoe. The matter shown in broken lines, namely, the outline of the shoe and the shoelaces, is not part of the primary features of the trade dress and serves only to show the position or placement of the primary features of the trade dress. The toe design depicted as stitching is part of the claimed mark.
