To Applicant's knowledge-- Centex Corp., having an address at 2728 N. Harwood, Dallas, Texas 75201 uses the mark RIVERWOOD to identify a real estate development located in El Jobean, Texas, but Applicant is uncertain as to the additional geographic area where the mark is used and the exact nature of the services. Centex Corp. owns Registration No. 2,957,285 for the mark RIVERWOOD. Centex Corp. acquired the mark through a predecessor-in-interest in 1998, but Applicant is not certain when the mark was first used although Registration No. 2,957,285 claims the mark was first used May 1992. Applicant does not know the mode of such use by Centex. Applicant believes that no one else except as specified in the application has the right to use the mark.
