The applicant claims exclusive use of the mark for medical services for the removal of hair, in class 44, in those states of the United States considered to be in the Eastern Standard Time Zone, including all of Tennessee, Kentucky, and Indiana. The excepted user may claim the area comprising those states of the United States not in the Eastern Standard Time Zone, and excluding all of Tennessee, Kentucky, and Indiana. U.S. Registration No. 2424923, for hair styling, and technical consulting in the fields of hair styling was filed on October 27, 1999, with use dates of August 27, 1999. The applicant's first use in commerce was July 1, 1999, a date prior to the registrant's filing date.
