To the extent of applicant's current knowledge, the following exception to applicant's right to exclusive use is : Pinnacle Rawhide, assignee from Western Town, LLC and the owner of service mark, trademark and trade name "Rawhide," as used for a wide variety of goods and services, and various federal registration for the mark "Rawhide" for restaurant services (Reg. No. 1,167,730) recreational park facilities simulating an old western town (Reg. No. 1,169,697) and retail store-related services. Pinnacle Rawhide, through its predecessors, has use in the "Rawhide" dating back to 1970 for a variety of goods and services emanating from the Rawhide western theme town and restaurant located in Scottsdale, Arizona. Pinnacle Rawhide, LLC has mailing address as follows:c/of Pinnacle Sonoran Properties, 23733 North Scottsdale Road, Scottsdale, Arizona 85255. This exception listed above is, to the applicant's knowledge owned and controlles by a separate and unrelated corporate entity. Applicant does not believe that the exception listed above is the subject of any application for registration in the U.S. Patent and Trademark Office, which belief is based on the execution of a Settlement, Concurrent Use and Coexistence Agreement dated February 5, 1999. Further, the applicant has not and will nor use the mark in the states of Arizonia and New Mexico which practice will avoid any lilkelihood of confusion, mistake, or deception in the market place as to the source of the goods and services resulting from the continued concurrent use of the mark.
