The following exception to the applicant's claim of exclusive use is specified: by the Colorado Milling & Elevator Company, doing business as Eagle Flour Mills, located and doing business at Denver, Colorado, and (upon applicant's information and belief) using the mark "Pure Gold" Registration No. 257,336, dated June 4, 1929 (renewed) in connection with Wheat Flour, by applying said mark to the containers for the goods, in the territory embracing the States of Alabama, Arizona, Arkansas, California, Colorado, Connecticut, Delaware, Florida, Georgia, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Louisiana, Maine, Maryland, Massachusetts, Minnesota, Mississippi, Missouri, Montana, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Dakota, Ohio, Oklahoma, Oregon, South Dakota, Tennessee, Texas, Utah, Vermont, Washington, West Virginia, Wisconsin, and Wyoming.
